Mediation
Trott & Gentry has its own in-house Mediator in one of its senior partners, Stanley Saffer is a CEDR Accredited Mediator and has carried out a variety of Mediations over the years. Mediations can apply to all manner of disputes, but in particular to contractual claims, personal injury claims, landlord and tenant claims, inheritance claims and partnership disputes.
It is the considered consensus both of lawyers and, in particular, of the Courts that in any dispute Mediation should first be attempted, before the matter goes to a full trial. In a situation where the parties, even though far apart in their thinking, have a common interest to resolve issues, Mediation can be a very powerful tool in both speeding up the process and reducing costs. This is now recognised by Judges throughout England and Wales and Mediators are playing an ever increasing and ever more important role in all manners of disputes.
If a party unreasonably refuses to enter into mediation, the courts can take this into account when determining the issue of costs at trial.
